About this Case
Madison Metropolitan Public Schools want to hide information from students’ parents regarding their transgender identify at school. If, in the school personnel’s opinion, the parents will not support the child’s decision, the school is withholding this critical information. These parents are seeking an injuction against the school system.
Summary of NLF's Brief
Our brief highlights two points that are not addressed in detail by the parents. First, the Policy wrongly denies important, relevant information that parents need in order to fulfill their right to decide where their child will attend school, which is part of their fundamental right to direct the care and education of their children. Second, by withholding this sensitive information because school officials suspect that parents might not be supportive, the school is labeling parents as negligent without due process protection provided by both statutory and constitutional law. The requested injunctive relief is fully supported by the damage both of these constitutional violations provide.
